Article 1 - Definition
“Terms and Conditions of Use” or “T&C’s”: means these terms and conditions governing the use of the Website.
“Pathé Films Pro Space” or “Account”: refers to the interface hosted on the Website where all data provided by the Professional is gathered.
“Professional”: refers to the internet user holding a Pathé Films Pro Space. The professional must belong to one of the following professional categories: blogger or content creator, Pathé collaborators, cinema operators, press, brand promotion and partnerships, TV&SVOD, VOD & Video.
“Website”: refers to the pathefilms.com website.
“Visitor”: refers to the internet user who connects to the Website and/or wishes to access the content available on the Website.
Article 2 - Purpose of the Website
The purpose of the Website is to provide Visitors with information relating to films in the Pathé catalog, whether they are currently showing, coming soon, or available on video and video on demand (VOD).
The Website allows Visitors, among other things, to:
- Consult film pages including editorial elements (synopsis, trailers, visuals, release dates, technical and artistic information);
- Discover films in theaters, upcoming releases, as well as works available on DVD, Bluray, and VOD;
- Access the Pathé Films catalog, including restored heritage films and contemporary works;
- Subscribe, if applicable, to a newsletter to receive information on upcoming releases and news from Pathé Films.
The Website also offers a Pathé Films Pro Space accessible upon authentication, allowing Visitors with a professional account to access complementary content and materials related to the films (promotional materials, communication documents, etc.).
Article 3 – Scope and Modification of the Website’s T&C’s

The T&C’s govern the use of the Website and any related services.

Article 5 - Intellectual Property

Unless otherwise stated regarding the exploitation of promotional material, the Website and each of its components (audiovisual, textual, sound, graphic and photographic elements, etc.) (hereinafter the “Content”) are the exclusive property of Pathé Films. The reproduction, download, representation, adaptation, modification, transmission, distribution of all or part of the Content is prohibited, except for the exclusive purposes of information for personal and private use. The inclusion of the Website’s Content on a third-party website or mobile application without prior authorization from Pathé Films is prohibited.
Brands
All trademarks or logos appearing on the Website are subject to the intellectual property rights that may be held by Pathé Films, a company of its group or a third party in relation to it. Any use, in any way whatsoever, of these trademarks and/or logos is prohibited. Pathé Films or any company holding intellectual property rights reserves the right to claim damages in case of infringement of its rights.

Use of Promotional Material
Pathé Films makes available to Professional promotional material such as posters, photos, teasers, educational material, spots, etc. relating to films (hereinafter "Promotional Material"). The Promotional Material is accessible only to Professional with an Account on our Website and who are logged in. The Promotional Material available varies depending on your professional category.
By using the Promotional Material provided by our Website, you accept the terms of this non-exclusive, revocable, and limited license, granted in accordance with the intellectual property code. You are authorized to:
- Use the Promotional Material for the promotion of our products and services in compliance with the terms defined.
- Do not modify, adapt, translate, rent, sell, or distribute the Promotional Material without our prior written consent.
- Do not infringe upon the copyrights, trademarks, or other intellectual property rights associated with the Promotional Material.
This license is granted for a term equal to the duration of publication of the Promotional Material on the Website and for the entire world, and may be terminated by Pathé Films at any time for non-compliance with its terms. Any use of the Promotional Material outside the limits of this license may result in legal action.
Opposition to text and data mining by generative artificial intelligence by AI
The structure of the present Website as well as the entirety of audiovisual works and content present on the Website, as well as the entirety of their components (text, graphics, signs, signals, sounds, images, etc.) are protected by intellectual property law and may not be used without the prior written authorization of Pathé Films.
As needed, Pathé Films hereby objects to any digital copies or reproductions of these audiovisual works, content, and/or any of their copyrighted components (text, graphics, signs, signals, sounds, images, etc.) for the purpose of text and data mining by a generative Artificial Intelligence system (IAG), within the meaning of Articles L. 122-5-3,III and L. 211-3,8° of the Intellectual Property Code (CPI), transposing Directive (EU) 2019/790 of April 17, 2019 on copyright and related rights in the Digital Single Market.
Article R. 122-28 of the CPI specifies that this opposition “ does not need to be justified and can be expressed by any means. In the case of content made available to the public online, this opposition can notably be expressed through machine-readable means, including metadata, and by using the terms and conditions of use of a website or service.”
It is recalled that in the context of its activities, Pathé Films may authorize its contractors and/or press organizations to use the audiovisual works, content, and/or any of their copyrighted components (text, graphics, signs, signals, sounds, images, etc.)present on the Website, to the extent strictly necessary for the carrying out of the authorized exploitation or for information purposes. However, these authorizations do not permit these contractors and/or press organizations to make digital copies or reproductions of these works and/or content and/or their components for text and data mining, nor to authorize a third party to do so, particularly a generative AI system.
Consequently, all text and data mining operations by an AI system using audiovisual works, content and/or any of their copyright-protected components (text, graphics, signs, signals, sounds, images, etc) presented or made available to the public online on the Website or by third parties, whether this making available is done by extracts or in its entirety, in free access free of charge or for a fee, constitute acts of infringement, punishable by the sanctions provided for in L. 331-1 et seq. of the CPI, unless prior written agreement is obtained from Pathé Films (or, where applicable, from the collective management organization to which Pathé Films has expressly entrusted a mandate to this effect).

Article 6 - Visitor Conduct
Each Visitor must use the Website responsibly, with respect and courtesy towards the rights of other Internet users, and in this regard must refrain from, among other things:
- Making statements, behaving, or publishing content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, contrary to public morals, infringing on a person's privacy, including their right to image, hateful or derogatory, or offensive on a racial, ethnic, or other basis;
- Using the Website to display, email, or transmit to Visitors, by any other means, any unsolicited or unauthorized advertising or promotional material, or any material containing software viruses or other malicious computer code, files, or programs;
- Infringing upon the peaceful access and use of the Website by Visitors
- Accessing confidential data and private servers of Pathé Films ;
- Attempting to probe, scan, or test the vulnerability of a system or network, or to bypass security or authentication measures without authorization and outside the scope of Pathé Films' Coordinated Vulnerability Disclosure Policy accessible on the Website;
- Impersonating another person;
- Committing any illegal act.
In case of non-compliance with these obligations or prohibitions, Pathé Films reserves the right to take the following measures, without notice or compensation:
- Temporary or definitive suspension of access to the Website;
- Deletion of the Account, as applicable
- Reporting to the competent authorities in case of infringement; and/or
- Initiating legal proceedings for any damage suffered by Pathé Films or third parties.
Article 7 – Pathé Films Pro Space
The Professional may require a Pathé Films Pro Space to use certain services of the Website.
Article 8 - Liability
Pathé Films will do everything possible to ensure the proper and secure operation of the Website at all times. In no event shall Pathé Films be held responsible for any direct or indirect damage that any Visitor may suffer as a result of consulting or using the Website, whatever the causes, origins, nature or consequences, and in particular in case of interruption or unavailability of the Website, as well as in case of damage resulting from the presence of any malicious computer code, including but not limited to computer viruses, or fraudulent acts by third parties (such as intrusion) from the Website. The unavailability of the Website shall not give rise to any compensation. Furthermore, Pathé Films cannot be held responsible for any use contrary to the T&Cs.
Article 9 - Personal Data and Cookies
Pathé Films may collect personal data concerning the Visitor, particularly when the Visitor browses the Website, logs in, subscribes to the newsletter, sends a request via Customer Service, or sends an email to one of the addresses mentioned on the Website. Pathé Films undertakes to comply with the regulations applicable to the protection of the Visitor's personal data, in particular the European General Data Protection Regulation 2016/679 of April 27, 2016 (hereinafter the "GDPR") and the French Data Protection Act. The Visitor has the right to access, rectify, portability, erase, and restrict the processing of their data. If the Visitor believes that Pathé Films has not processed their data in accordance with the personal data protection regulations, the Visitor has the option to file a complaint with the CNIL: https://www.cnil.fr/fr/plaintes.

Article 10 - Non-waiver
The fact that Pathé Films does not avail itself of a breach by a user of one of the obligations referred to in these T&Cs shall not be interpreted as a waiver of the obligation in question.
Article 11 - Applicable law and jurisdiction
The T&Cs shall be governed and interpreted in accordance with French law. Any action arising from or resulting from your use of the Website or the T&Cs must be brought before the competent French courts.
