Terms and conditions of use of the Pathé Films account

Article 1 - Presentation and Definitions

1.1 Presentation

The Pathé Films Pro Space (hereinafter "The Pathé Films Pro Space") is managed by Pathé Films, a simplified joint-stock company with a capital of 5,545,420 euros, registered with the Paris Trade and Companies Register under number 780 077 921, whose registered office is located at 1 rue Meyerbeer – 75009 Paris, France and (hereinafter "Pathé Films").
The Pathé Films Pro Space is a dedicated space exclusively reserved for professionals belonging to one of the following categories: bloggers or content creators, collaborators of the Pathé group, cinema operators, press professionals, brand and partnership promotion actors, TV broadcasters and SVOD services, as well as VOD and video professionals (hereinafter the "Professional").


The Pathé Films Pro Space allows the Professional, after creating and validating their account, to:

  • manage their personal information;
  • access content, resources, and communication materials relating to Pathé Films' works, events, and news;
  • consult, where applicable, documents and materials made available for professional purposes on the website www.pathefilms.com (hereinafter the "Website").
     

Access to and use of the Pathé Films Pro Space are subject to compliance with these Terms and Conditions of Use.
The Professional is invited to read them carefully for any information regarding the terms of access, use, and conditions applicable to the content offered on the Site.

1.2 Definitions


"Terms and Conditions of Use" or "T&C’s": refers to these terms of use for the Pathé Films Account made available in a dedicated tab on the Site, describing the terms for creating and using the Pathé Films Account.
"Professional": refers to the internet user holding a Pathé Films Pro Space belonging to one of the following categories: bloggers or content creators, collaborators of the Pathé group, cinema operators, press professionals, brand and partnership promotion actors, TV broadcasters and SVOD services, as well as VOD and video professionals


Article 2 – Subject, Acceptance and Modification of the T&C’s


2.1 Subject


The T&C’s aim to describe the various terms for creating and using the Pathé Films Pro Space. The use of the content and communication materials made available through the Pathé Films Pro Space is subject to the Terms and Conditions of Use of the Website, which are expressly incorporated herein by reference and deemed accepted by the Professional.

2.2 Acceptance and entry into force


The T&C’S are deemed to enter into force upon the creation of their Pathé Films Pro Space by the Professional, following their acceptance of the T&C’s. Acceptance of these T&Cs entails acceptance of all documents expressly incorporated herein by reference.
The creation and use of the Pathé Films Pro Space are therefore subject to the Professional's acceptance and compliance with these T&C’s.
The applicable T&C’s are those that were agreed to by the Professional at the time of creating their Pathé Films Pro Space or those accepted and/or communicated during modifications or updates.
The Professional agrees to carefully read the T&C’s when creating their account and is invited to download, print, and keep a copy.

2.3 Modification


The T&C’s may be modified and updated by Pathé Films at any time, particularly to adapt to legislative or regulatory changes.
Should any clause of these T&C’s be null due to a change in legislation, regulation, or a court decision, this shall not in any way affect the validity and compliance with the other clauses of the T&C’s.
Modifications that do not significantly affect the Professional's rights or obligations (such as minor adjustments, corrections, or technical modifications) do not require express acceptance by the Professional. These modifications will take effect upon their online publication.
Any substantial modification of the T&C’s, likely to significantly impact the Professional's rights or obligations, will be subject to prior notification. The Professional will be invited to expressly accept these modifications before continuing to use the services. Substantial modifications will take effect on the date indicated in the notification sent to Professionals.
Professionals will be informed of substantial updates via an email sent to the address associated with their Pathé Films Pro Space or via a notification on the interface of their Pathé Films Pro Space. In case of refusal of substantial modifications, the Professional may delete their Pathé Films Pro Space.


Article 3 – Creation of the Pathé Films Pro Space


3.1 Terms for creating the Pathé Films Pro Space


The creation of a Pathé Films Pro Space is reserved for Professionals. Pathé Films reserves the right to request any document at any time to verify the identity of the person, particularly in cases of same names or multiple accounts attributed to the same identifier.


To create their Pathé Films Pro Space, the Professional must fill out the dedicated form, providing:*

  • A valid email address;
  • A password;
  • A professional category;
  • Their first and last name;
  • A phone number;
  • Their job title or position and the name of the company they work for.
     

Once the creation of the Pathé Films Pro Space is complete, a registration confirmation is sent by email to the address provided during registration.

3.2 Authentication information


The Professional's login for accessing their Pathé Films Pro Space is the email address provided during its creation.
When the Professional creates their Pathé Films Pro Space, they are asked to choose and enter a password that meets the Site's security requirements.
It is recommended to choose a password specific to the Pathé Films Pro Space and not to reuse a password used on another site. Thus, in case of disclosure of a dedicated password, only the concerned service will be affected. A password should not be easily guessable. Therefore, it is advised not to include common words (e.g., "password"), logical character sequences (e.g., "1234"; "abcd"; "azerty"), or personal information identifying the Professional such as first name, last name, and date of birth in a password.


Article 4 – Use of the Pathé Films Pro Space and liability


4.1 Security of the Pathé Films Pro Space


The Professional is solely responsible for any loss and/or damage resulting from incomplete or false registration. The login and password are strictly personal, and the Professional is solely responsible for maintaining their confidentiality. They must ensure that no one else uses them. Actions performed using the Pathé Films Pro Space will be attributed to the Professional. Pathé Films must be immediately informed of any unauthorized use (suspected or actual) of their Pathé Films Pro Space, any security breach (suspected or actual), including loss, theft, or disclosure (accidental or not) of their login and password. The Professional must then reset their password to secure their Pathé Films Pro Space.
In any event, Pathé Films cannot be held responsible for any activity that occurs on the Pathé Films Pro Space. As such, the Professional agrees to use the Pathé Films Pro Space in accordance with the provisions set forth in the T&C’S. Failure to do so may result in Pathé Films suspending or deleting the Professional's Pathé Films Pro Space.


4.2 Duration of the Pathé Films Pro Space


The Pathé Films Pro Space remains active until it is deleted under the conditions specified below:
The Professional may at any time request the deletion of their Pathé Films Pro Space from their account via the “Delete my account and all data" feature, provided they are logged into their Pathé Films Pro Space. Pathé Films will proceed with the deactivation of the Pathé Films Pro Space and will send the Professional an email confirming the closure of their Pathé Films Pro Space.


Pathé Films reserves the right to close a Pathé Films Pro Space in case of violation of any of the prohibitions mentioned below:

  • Actions contravening the provisions of the Intellectual Property Code, particularly the provisions mentioned in the "intellectual property" article of the Site's T&C’S;
  • Use of the Pathé Films Pro Space for commercial purposes;
  • Breach of any of the obligations incumbent upon them under these T&C’S;
  • In the event of suspected fraud.


4.3 Accessibility and availability of the Pathé Films Pro Space

Pathé Films cannot be held responsible in case of:

  • Inability of the Professional to access their Pathé Films Pro Space due to any malfunction, particularly technical and/or IT related;
  • During service maintenance;
  • In case of force majeure, i.e., in the event of an occurrence presenting the characteristics of force majeure, as defined by French law and jurisprudence, making it impossible to maintain access to the Pathé Films Pro Space;
  • Damage or alteration suffered by the Professional to their computer equipment, as a result of using their Pathé Films Pro Space and/or the Site(s) provided for this purpose.
     

In all the above-mentioned cases, the Professional shall not be entitled to any refund or compensation of any kind whatsoever.


Article 5 - Personal data


Pathé Films may collect personal data concerning the Professional, particularly at the time of creating their Pathé Films Pro Space.
Pathé Films undertakes to comply with the regulations applicable to the protection of the Professional's personal data, particularly the General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016, and the French Data Protection Act (Loi Informatique et Libertés).
The Professional has the right to access, rectify, port, erase, and restrict the processing of their data, which they can exercise by sending Pathé Films a written request via the contact form accessible on our Site(s) (link "Contact Us" available at the bottom of the page) provided they are logged into their Pathé Films Account, or by mail to the following address: DPO PATHE, 1 rue Meyerbeer 75009 Paris (France).
Pathé Films' Data Protection Officer can be contacted for any request via the email address dpo@pathe.fr. If the Professional believes that Pathé Films has not processed their data in accordance with data protection regulations, they have the option to file a complaint with the CNIL: https://www.cnil.fr/fr/plaintes. For more information on the processing of personal data, the User is invited to consult the "Data Protection Charter" accessible on the Site: https://www.patheFilms.com/policy


Article 6 - Applicable law, competent jurisdiction


These T&C’S, as well as the relations between the Professional holding the Pathé Films Pro Space and Pathé Films, are subject to French law, and any dispute arising from or in connection with them shall be submitted to the competent French courts. Any dispute that may arise concerning their validity, acceptance, execution, non-execution, or interpretation shall first be subject to an attempt at amicable settlement.
